Terms and Conditions

Please read these Terms and Conditions ("Terms") carefully before using the BodyRecomp mobile application or website operated by Koa Ventures LLC ("Company", "we", "us", or "our"). By accessing or using BodyRecomp, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not use our services.

1. Acceptance of Terms

By downloading, installing, or using the BodyRecomp App or website, you confirm that you are at least 13 years of age, have read and understood these Terms, and agree to be legally bound by them. If you are under 18, you represent that your parent or guardian has reviewed and agreed to these Terms.

2. Description of Services

BodyRecomp provides a mobile fitness application offering personalized workout programs, meal planning tools, calorie and macro tracking, and related fitness content ("Services"). The Services are available on iOS and Android platforms.

The information provided through BodyRecomp is for general fitness and wellness purposes only and does not constitute medical advice. Always consult a qualified healthcare provider before starting a new exercise or nutrition program.

3. User Accounts

You must create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately if you suspect unauthorized use at support@bodyrecomp.app.

4. Subscriptions and Billing

BodyRecomp offers a free tier and a Premium subscription. Premium subscriptions are offered on a monthly ($9.99/month) or annual ($59.99/year) basis.

  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
  • Payment is charged to your App Store or Google Play account upon purchase confirmation.
  • You may manage and cancel your subscription through your App Store or Google Play account settings.
  • Refunds are subject to the refund policies of Apple App Store or Google Play, as applicable.
  • We reserve the right to modify subscription pricing with 30 days' notice.

5. Free Trial

New users may be offered a free trial period for Premium. The trial will automatically convert to a paid subscription unless cancelled before the trial ends. You will not be charged during the trial period.

6. Prohibited Use

You agree not to:

  • Use the Services for any unlawful purpose or in violation of any regulations.
  • Copy, modify, distribute, sell, or lease any part of the Services.
  • Reverse engineer or attempt to extract the source code of the App.
  • Use automated tools to access or scrape the Services.
  • Share your account credentials with others.
  • Upload content that is offensive, defamatory, or infringes third-party rights.
  • Interfere with the integrity or performance of the Services.

7. Intellectual Property

All content within BodyRecomp — including workout programs, meal plans, text, graphics, logos, and software — is the property of Koa Ventures LLC and protected by applicable copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

8. User-Generated Content

If you submit feedback, reviews, or other content to us, you grant Koa Ventures LLC a non-exclusive, royalty-free, worldwide license to use, modify, and display such content in connection with operating and improving the Services.

9. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES. BODYRECOMP DOES NOT PROVIDE MEDICAL, DIETARY, OR THERAPEUTIC ADVICE.

RESULTS FROM USING BODYRECOMP VARY BY INDIVIDUAL. WE MAKE NO GUARANTEES REGARDING FITNESS, WEIGHT LOSS, OR BODY COMPOSITION OUTCOMES.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KOA VENTURES LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM YOUR USE OR INABILITY TO USE THE SERVICES.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU TO KOA VENTURES LLC IN THE SIX MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Koa Ventures LLC and its affiliates from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.

12. Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms. You may terminate your account at any time by contacting us at support@bodyrecomp.app. Upon termination, your right to use the Services ceases immediately.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Hawaii, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Hawaii.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date and, where appropriate, by sending an email notification. Continued use of the Services after changes constitutes acceptance of the revised Terms.
