Terms and Conditions for Complimentary Product Offer by Koa Ventures LLC
- Eligibility: The complimentary product offer is exclusively available to subscribers with 3, 6, or 12-month memberships of Koa Ventures LLC. Any other membership tiers or non-subscribers are ineligible.
2. Product Selection Limit:
– 3-month membership: Maximum of 2 products.
– 6-month membership: Maximum of 3 products.
– 12-month membership: Maximum of 4 products.
3. Over-Selection: Should a member select more products than permissible, only products corresponding to the member’s subscription length will be dispatched, counting from the first selection.
4. Shipping & Delivery: Expected delivery time is within 30 days from the date of product selection. Unforeseen external factors may affect these timelines. Koa Ventures LLC is exempt from liability for delays arising from third-party shipping providers, customs interruptions, or other unforeseen externalities.
5. Product Conditions: Complimentary items are provided “as is” without warranty of any kind, either express or implied, including but not limited to fitness for a particular use.
6. Liability: Under no circumstance will Koa Ventures LLC be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or in connection with the complimentary products, whether based on warranty, contract, tort, or any other legal theory, even if informed of the possibility of such damages.
7. Amendments: Koa Ventures LLC reserves the right, at its sole discretion, to modify, add, or remove portions of these terms at any time without prior notice. It’s the member’s responsibility to review these terms periodically for changes.
8. Jurisdiction: Any disputes arising from these terms will be litigated or arbitrated in Atlanta, Georgia. Members waive any and all objections to exercising jurisdiction over them by such courts and to venue in such courts.
9. Waiver & Severability: Failure to exercise any right under these terms shall not constitute a waiver of such right. If any provision of these terms is deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these terms and will not affect the validity and enforceability of the remaining provisions.
10. Entire Agreement: These terms constitute the entire agreement between the member and Koa Ventures LLC regarding the complimentary product offer and supersede all prior communications, agreements, or understandings of any kind.
